1. Acceptance of Terms

By accessing or using the Trusted House Painter website and related services (collectively, the “Service”), you acknowledge that you have read, understood, and agreed to be legally bound by these Terms of Service and by our Privacy Policy, which is incorporated by reference. If you do not agree to these terms, you must immediately discontinue use of the Service.

We will provide reasonable advance notice of material changes to these Terms, either by email or by posting a notice within the Service. Your continued use of the Service after such notice constitutes acceptance of the updated Terms.

2. Eligibility and Scope of Service

The Service is intended primarily for homeowners and professional painting contractors located in Canada and the United States, although it may be accessed from other jurisdictions. You represent and warrant that you are at least eighteen (18) years of age and that you have the legal capacity to enter into this agreement. If you access the Service from outside of Canada, you do so at your own risk and are solely responsible for complying with the laws of your local jurisdiction.

3. Permitted Use and Restrictions

You agree to use the Service only for lawful purposes and in accordance with these Terms. Any misuse of the platform, including but not limited to the scraping of data, unauthorized reproduction of content, attempts to hack or disrupt the platform, or the posting of false or misleading information, is strictly prohibited. You may not use the Service to compete with Trusted House Painter, to resell or distribute leads outside the parameters established in our platform, or to otherwise exploit the Service in ways not expressly authorized by us.

4. Intellectual Property Rights

All materials available through the Service—including but not limited to text, design, graphics, logos, trademarks, software, and proprietary databases—are the property of Trusted House Painter or its licensors. Except as expressly permitted by us in writing, no part of the Service may be copied, reproduced, distributed, transmitted, or otherwise exploited for commercial purposes. Unauthorized use may result in legal action.

5. Payments, Subscriptions, and Refunds

Certain features of the Service, including access to shared or exclusive leads, may require payment. By submitting payment information, you authorize Trusted House Painter to charge the applicable fees. Unless otherwise expressly stated, all fees are final and non-refundable, except where required by applicable law. Subscriptions, if offered, renew automatically unless canceled in accordance with the instructions provided in your account. We reserve the right to adjust pricing, subscription terms, and service features at any time, with reasonable notice to affected users.

6. User Obligations and Representations

As a user, you agree to provide complete and accurate information in all interactions with the Service, including but not limited to business listings, homeowner requests, and payment details. You are solely responsible for the information you submit and for the consequences of its use.

Homeowners acknowledge that any engagement with painters or contractors found through the Service is undertaken at their own risk, and contractors acknowledge that they are responsible for the quality and legality of their work. Trusted House Painter does not guarantee the accuracy of user-submitted information or the outcomes of any business relationship formed through the platform.

Trusted House Painter is not a party to any contract entered into between homeowners and painting contractors. We do not supervise, direct, or control the quality, timing, legality, or performance of any work performed, and we disclaim all responsibility arising from such engagements.

7. Disclaimers and No Guarantees

The Service is provided “as is” and “as available” without warranties of any kind, whether express or implied. Trusted House Painter does not warrant that the Service will be uninterrupted, error-free, or secure, nor do we guarantee that leads will result in successful business transactions, completed projects, or satisfied clients.

While we may use artificial intelligence and other technologies to personalize recommendations and improve user experience, you understand and agree that such tools are not error-free and should not be relied upon as professional advice.

We do not warrant or guarantee the accuracy of user-submitted information, including business credentials, licenses, or reviews. Users are responsible for conducting their own due diligence before entering into agreements.

8. Limitation of Liability

To the fullest extent permitted by law, Trusted House Painter, its officers, directors, employees, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or relating to your use of the Service, including but not limited to loss of profits, loss of goodwill, or business interruption.

In no event shall our total liability to you exceed the amount you paid to us, if any, during the twelve (12) months preceding the event giving rise to the claim.

In addition, we expressly disclaim any liability for damages or losses arising from user-submitted content, misrepresentations, or disputes between homeowners and contractors.

9. Indemnification

You agree to indemnify, defend, and hold harmless Trusted House Painter, its owners, employees, and affiliates against any claims, liabilities, damages, losses, or expenses (including reasonable attorney fees) that arise out of or relate to your use of the Service, your violation of these Terms, or your violation of any applicable law or the rights of a third party.

10. Termination

We reserve the right, in our sole discretion, to suspend or terminate your access to the Service at any time and for any reason, including but not limited to violations of these Terms or suspected fraudulent activity.

Upon termination, all rights granted to you will immediately cease, and you must discontinue all use of the Service.

Upon termination, Sections 4 (Intellectual Property), 5 (Payments), 7 (Disclaimers), 8 (Limitation of Liability), 9 (Indemnification), 12 (Governing Law), and any other provisions that by their nature should survive, shall continue in full force and effect.

11. Third-Party Services and Links

The Service may contain links to third-party websites, tools, or services. We do not control and are not responsible for the content or practices of third parties, and inclusion of such links does not imply endorsement. You access third-party services at your own risk and subject to their respective terms of use and privacy policies.

12. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the Province of British Columbia, Canada, without regard to its conflict of law provisions. Any dispute arising under or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts located in British Columbia.

Use of the Service is also subject to the Personal Information Protection Act (PIPA) of British Columbia and any other applicable privacy or consumer protection laws.
